Is the transfer of licenses Xbox profile specific?

My brother recently bought a slim 360. Unfortunately before this was piggy backing up my system. (Also known as the profile purchases were made live on my console), this presents two problems. one: we can not do a migration traditional data, because I still want to use my console and do not want my data wiped. any solution? Two: Does the license consolidation tool profile specific.
